When I first received a court claim from ParkingEye for nearly £200, I was shocked not least because I had never even received a parking ticket in the post before that.
The incident dated back to January 2023, when I took my child to a seven-year-old league football match at a ground I had never visited before. We were already running late due to traffic and getting slightly lost on the way. In the rush to get inside, I didn’t notice any parking signs. We were there for about an hour before leaving.
Months later, my car was involved in an accident and I was no longer the keeper. Then, out of the blue, I received a County Court Claim from ParkingEye. I couldn’t believe it no warning, no PCN, nothing until they were trying to take me to court.
Building My Defence
I wasn’t going to just accept it, so I used ParkingMate UK to prepare a full legal defence. My case wasn’t just about “I didn’t see the signs” it challenged ParkingEye’s claim on multiple legal points:
- Failure to Follow Court Rules (CPR 16) – Their claim didn’t explain how the contract was formed, what terms were breached, or even the specific conduct they were relying on.
- Insufficient Particulars of Claim – I cited the Civil Enforcement v Chan case, where similar vague claims were struck out for not detailing the alleged breach.
- Unlawful Extra Charges – They had added £70 to the £100 charge, which is not allowed under consumer law and had already been ruled a penalty in previous cases.
- Request for Evidence – I demanded proof of landowner authority, DVLA keeper requests, and signage photos from the date putting them in a position where they’d have to prove their claim in detail.
The Outcome
Before the case even reached a hearing, ParkingEye discontinued the claim. The court confirmed in writing that the matter was closed meaning I didn’t have to pay them a penny.
My Review
“ParkingMate UK made what felt like a nightmare situation incredibly easy to deal with. The defence they prepared was detailed, professional, and clearly made ParkingEye realise they had no case. I’m so glad I didn’t give in and pay something I never owed in the first place.” – Alex
